Justice for Jayesh and James - nearly there

RMT General Grades Committee decision:

We note that Jayesh Patel has accepted reinstatement to his substantive role as a train driver from February 2012. We note that this is a huge reduction in the sanction initially imposed on him by London Underground.

We also note that London Underground has agreed to reinstate James Masango, but that the terms of this reinstatement are still under discussion.

We congratulate Jayesh, James and their workmates and fellow union activists across London Underground for their determination to secure an acceptable outcome to these cases. RMT has shown once again that it is willing and able to defend its members.

We instruct the General Secretary to place this matter back in front of us immediately agreement is reached for the full reinstatement of James Masango or in the event that discussions break down.

We note with concern the report from our Regional Organiser about the lawyers’ handling of this case. We instruct the General Secretary to convene an urgent meeting between himself, our Regional Organiser, James’ Branch Secretary and the lawyers to discuss our Regional Organiser’s concerns.

We further instruct the General Secretary to update us with the progress of the formal complaint to the Office of the Rail Regulator included in our decision of 29 September 2011.

London Transport Regional Council and branches with London Underground members to be advised.
